Terms of Use

Access to, and use of EFL247 and other services (referred to below as EFL247 services), provided by ABC Community Services (registered company name), is subject to the following Terms of Use.

  1. By using EFL247, you agree to be legally bound by these terms. This shall immediately take effect on your first use of EFL247 services. If you do not agree to be legally bound by the following terms, please do not register, access and/or use EFL247 services.
  2. EFL247 may change these terms at any time by posting changes online. You should review these terms regularly, to ensure you are aware of changes made by EFL247. Your continued use of EFL247 services after changes are posted means you agree to be legally bound by these terms when updated and/or amended.

Access to EFL247 services

  1. EFL247 is a business-to-business service, not a service for individuals. Registration for membership is only allowed for business owners or employees at businesses. You are not allowed to register as a member if you are under 18 or do not have full legal capacity.
  2. Full access to EFL247 services are only given to business owners and key staff at businesses that have bought a subscription. Unless cancelled, the subscription is automatically renewed and invoiced. Invoices are normally sent as an email.
  3. A paid subscription can be cancelled at any time by giving at least thirty (30) days notice prior to the end of the present license period. This should be done online using either the feature ”Cancel Subscription” in the section ”My company” or by sending a message through this section to “Customer support”. Your account remains active for the pre-paid time. EFL247 does not issue prorated refunds.
  4. Prices and other terms for subscriptions and other services are provided on the site, www.EFL247.com. All registered users are informed by an on site message of any changes in these Terms of Use, which is provided to users thirty (30) days in advance.
  5. Subscriptions for tools and other add-ons are available to pay a company member. EFL247 does not issue prorated refunds.


Use of EFL247 services

  1. Unless otherwise stated, you may not copy, reproduce, republish, download, post, broadcast, transmit or otherwise use content from EFL247 subscription services in any way. Exceptions include personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any EFL247 services, except for your own personal, non-commercial use.
  2. You agree to use EFL247 services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of EFL247 services. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within EFL247 services.
  3. Beware of fraud, phishing attacks, etc. Make sure you are visiting the EFL247 website when you log in and enter information. We will never contact you or ask you to provide your password, credit card information, etc, by email, phone or fax.



Disclaimers and limitation of liability

  1. EFL247 subscription services, including information, names, images, pictures, logos and icons regarding or relating to EFL247, EC Learning Solutions, its products and services (or to third party products and services), is provided "AS IS" and on an "IS AVAILABLE" basis.  This is available without any representations or any kind of warranty made (whether express or implied by law), including implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
  2. EFL247 is not liable for any damages, including indirect or consequential damages, or those damages arising from use or loss of use, data or profits.  This includes damages arising in contract, negligence or other torturous actions that may occur from or in connection to the use of EFL247 subscription services.
  3. EFL247 does not warrant that functions contained in EFL247 subscription services will be uninterrupted or error free, or that defects will be corrected, or that EFL247 subscription services or the server that makes it available will be free of viruses or bugs.
  4. Any opinion expressed in this community should be considered solely as an expression from an individual member. EFL247 takes no responsibility for information given by members in the community, through the classifieds section or other parts of the Site. You are solely responsible for all information given.



Intellectual property

  1. The names, images and logos identifying EFL247 or third parties and their products and services are subject to copyright, design rights and trade marks from EFL247 and/or third parties. Nothing contained in these terms shall be construed as conferred by implication, estoppal or any licence or right to use any trademark, patent, design right or copyright of EFL247 or any other third party.

    Contributions to EFL247 services
  2. By submitting your contribution to EFL247 subscription services, you:

16.1 warrant it is your contribution; and

16.1.1 is your original work and that you have the right to make it available to EFL247 for all the purposes specified above; and

16.1.2 is not defamatory; and

16.1.3 does not infringe any law; and

16.2 indemnifies EFL247 against all legal fees, damages and other expenses that may be incurred by EFL247 as a result of your breach of the above warranty; and

16.3 waives any moral rights in your contribution for the purposes of its submission to and publication of EFL247 subscription services with the purposes specified above.

 

Copyright

  1. By downloading a file from EFL247 you agree to use it solely for your own personal or professional use. You are not allowed to change the content or redistribute the content to anyone except, if you are a teacher, to your students.
  2. Files provided by EFL247 in the part of the Resources section called “Online English” are copyright EC Learning Solutions (Online English).
  3. If you have EFL247 membership as a teacher you may upload files and share them with other members. By uploading a file to EFL247 you allow other members to use the file, while maintaining your copyright under a Creative Commons-license.

 

House Rules for EFL247 subscription services communities

  1. You agree to use EFL247 subscription services communities (including Forums, Messages and Groups) in accordance with the following House Rules:

About your posts:

 

Contributions must be civil and tasteful;

No rude or abusive behaviour (flaming or trolling). Postings must be constructive and polite, not mean-spirited or posted with the intention of causing trouble;

Unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable;

No spamming or repeated requests;

No advertising or other forms of directly promoting your products or services (Adverts are only allowed in the designated B2B Classifieds section, and business to business adverts);

Posts containing languages other than English or other official EFL247 language versions may be removed, unless allowed in the local house rules;

No impersonation. Adopting an inappropriate user name (one that is vulgar, offensive, etc.) is also unacceptable

 

Group administrator:

 

  If you are a group administrator you are responsible for moderating content and ensuring that group members comply with the Terms and Conditions of EFL247;

  You must comply with any reasonable request from EFL247 to amend, remove, or provide copies of any content of the club;

  Under no circumstances can details of any member be sold or passed to a third party;

  Should you choose to cancel your subscription you will remove your rights to administrate and lead the group. Depending on the activity within the group, EFL247 may offer the leader role to another member;

  The use of the EFL247 brand (name or logo) is prohibited without receiving prior permission.

 

About the law:

 

  You may not post any defamatory or illegal material of any nature in EFL247 subscription services communities. This includes text, graphics, videos, programs, audio or links. Posting a message with the intention of committing an illegal act is strictly prohibited;

  You agree to only post materials that provide you with copyright or other permissions to distribute electronically. You may not violate, plagiarise, or infringe on the rights of third parties through copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.

 

 

If you breach these Terms of Use:

 

If you fail to abide by these Terms of Use (including the house rules in the paragraph, above), you will be formally warned by email. This warning may also include a temporary suspension to participate in any or all of EFL247 Subscription Services Community areas. If, after this warning, you continue to breach these terms, you will be prohibited from using EFL247 Subscription Services Communities for an extended period of time, and your membership account may be closed permanently.

If you post or send offensive or inappropriate content anywhere on or to EFL247 Subscription Services Communities and EFL247 considers such behaviour to be serious and/or repeated, EFL247 may use whatever information available to stop any further infringements. This can include immediate termination of your membership account and may involve informing relevant third parties, such as your employer or email provider, about the infringement/s.

EFL247 reserves the right to delete any posting, at any time, for any reason.

 

General

  1. If any of these terms are determined as illegal, invalid or otherwise unenforceable by reason of laws of any state or country in which these terms are deemed effective, then, to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect, and continue to be binding and enforceable.
  2. These terms shall be governed by and interpreted in accordance to the laws of Sweden.

The information we collect

When you visit EFL247, you provide us with two types of information: (1) personal information you knowingly choose to disclose and that is collected by EFL247 and (2) website use information collected by EFL247 as you interact with our Website.

When you register with EFL247, you provide certain personal information and information about your school, such as your name, email address, and any other personal or preference information.

When you enter EFL247, we collect your IP address and browser type. We use session ID cookies to confirm users are logged in. These cookies terminate once the user closes the browser.  When you use EFL247, you may set up areas which include your personal profile, form relationships, messages, perform searches, form groups and transmit information. We collect this information so we can provide you with a professional service while offering personalised features.

You post content on the Site at your own risk. Although we allow you to set privacy options, which limits access to specific parts of your pages, you should be aware that these security measures are not perfect. We cannot control the actions of other users with whom you may choose to share your information with. Therefore, we cannot and do not guarantee that content you post on the Site will not be viewed by unauthorised persons. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You understand and acknowledge that, even after removal, copies of User Content may remain viewable in cached and archived pages, or if other users have copied or stored your content.

Any improper collection or misuse of information provided on EFL247 is a violation of the EFL247 Terms of Use and should be reported to info@efl247.com .

By using EFL247, you consent to have your personal data transferred and processed within the European Union.

EFL247 can not, in any way, guarantee information provided by registered members.

Use of information obtained by EFL247

When you register with EFL247, you create your own profile and privacy settings. Your profile information, as well as your name, email address, photo, etc, are displayed to people in the profile settings you have specified, which enables you to connect with other users.

Profile information is used by EFL247 primarily to be presented and edited by you when you access the service.  It is also used as a presentation to others permitted to view your information through your profile settings. Your name, network names and profile picture will be available in search results across the EFL247 network and limited pieces of information may be made available to third party search engines.

EFL247 may send you service-related announcements from time to time through the general operation of the service. For instance, if a contact sends you a new personal message, you may receive an email to alert you. EFL247 reserves the right to send you notices about your account, even if you opt out of voluntary email notifications.

EFL247 may use information in your profile without identifying you as an individual to third parties.

Sharing your information with third parties

EFL247 is, to a large extent, about sharing information with others members, while providing you with profile settings that restrict other users from accessing parts of your information. We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is 1) legally required, 2) reasonably necessary to offer the service or 3) permitted by you. For example:

1.       We may provide information to service providers to help bring you the services we offer. Specifically, we may use third parties to facilitate our business, such as to host the service at co-location facilities for servers, to send out email updates about EFL247, to process payments for products or services, or to provide search results or links (including sponsored links). In connection with these offerings and business operations, our service providers may have access to your personal information for use and for a limited time in connection with these business activities.

2.       Unlike most sites on the Web, EFL247 limits access to site information by third party search engines (Google, Yahoo, etc). EFL247 takes action to block access by these engines to personal information beyond name, blog (if any), company profile page, and limited aggregated data about your profile.

3.       We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, which may be in compliance with applicable laws. We do not reveal information until we have good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the EFL247 service or used through the EFL247 name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.

4.       If the ownership of the EFL247 business changes, your user information may be transferred to the new owner so the service can continue operations. In there is any such transfer of information, your user information would remain subject to the promises made in any pre-existing Privacy Policy.

When you use EFL247, certain information you post or share with third parties (e.g. someone in your network), such as personal information, comments, messages, photos, classifieds listings or other information, may be shared with other users in accordance with profile settings you select. All such sharing of information is done at your own risk.

Links and third party advertising

EFL247 may contain links to other websites. We are not responsible for the privacy practices of other websites. This Privacy Policy applies solely to information collected by EFL247.

Advertisements that appear on EFL247 are sometimes directed to users of third party advertisers. They may automatically receive your IP address when this happens. These third party advertisers may also download cookies to your computer, or use other technologies to measure the effectiveness of their ads or to personalise advertisement content. Doing this allows the advertising network to personalise advertising content. EFL247 does not have access to or control of the cookies that may be placed by third party advertisers. Third party advertisers have no access to your contact information stored on EFL247. This Privacy Policy covers the use of cookies by EFL247 and does not cover the use of cookies or other tracking technologies by any of its advertisers.

Changing or removing information

Access and control over most personal information on EFL247 is available through the profile settings tool. EFL247 users may modify or delete any of their profile information at any time by logging into their account. Information will be updated immediately. Individuals who wish to delete their EFL247 account may do so on “My Page”. Removed information may persist in backup copies for a reasonable period of time but is not generally available to members of EFL247.

However, if you make use of the communication features of the service to share information with other individuals on EFL247 (e.g. sending a personal message to another EFL247 user) you cannot remove such communications.

Security

EFL247 takes what we consider to be appropriate precautions to protect our users' information. Your account information is located on a secure server behind a firewall. When you enter sensitive information (such as a credit card number), we encrypt that information using secure socket layer technology (SSL).

Terms of Use, notices and revisions

Your use of EFL247, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use and all of its dispute resolution provisions.  This includes arbitration, limitation on damages and choice of law. We reserve the right to change our Privacy Policy and our Terms of Use at any time. Non-material changes and clarifications take effect immediately, and material changes take effect within 30 days of their posting on this site. Unless stated otherwise, our current privacy policy applies to all information we have about you and your account.
